What is a Rental Minimum Standards check — and why should you care?

Every rental property in Victoria must meet the Rental Minimum Standards set out under the Residential Tenancies Act 1997 and Residential Tenancies Regulations 2021 (Schedule 4). These standards are designed to ensure that every renter has a safe, secure, and functional home, and that landlords and property managers maintain their legal obligations.For landlords and agents, compliance isn’t optional — it’s the law. Failing to meet these standards can lead to hefty financial penalties, increased vacancy times, and reputational damage.

The Legal Risks of Non-Compliance

Under the Residential Tenancies Act:

  • Individuals (landlords or agents): up to 60 penalty units – currently over $11,000
  • Companies or agencies: up to 300 penalty units – more than $55,000

Section 65B, introduced on 25 November 2025, makes it a legal requirement that a rental property must not be advertised or offered for lease unless it already meets all Rental Minimum Standards.

This requirement applies on an ongoing basis.
Every property must be inspected and confirmed compliant before it is listed, rather than after a tenant moves in.
Non-compliance may result in advertising breaches, delays to leasing, or financial penalties.

Your Rental Minimum Standards Check will include:

  • Heating: A fixed heater in the main living area that meets current efficiency standards.
  • Bathrooms: Functional washbasin, shower or bath, and continuous hot and cold water.
  • Kitchens: Working sink, cooking facilities, and adequate food preparation space.
  • Lighting and Ventilation: Sufficient natural and artificial light, and proper ventilation in habitable rooms.
  • Structural Soundness: The property must be weatherproof, secure, and free from major damage or deterioration.
  • Windows and Doors: Functional locks, deadlocks where required, and openable windows for ventilation and safety.
  • Window Coverings: Bedrooms and living areas must have coverings that provide privacy and light control.
  • Sanitary Facilities: A functional toilet and hygienic waste connection.
  • Mould and Damp Prevention: The property must be free from mould or damp caused by structural or ventilation issues.
  • Blind Cord Safety: All blinds and curtains in bedrooms and living areas must have secured or tensioned cords to prevent safety hazards.
